A US Army sergeant was found guilty of assaulting a Marine during a court-martial, according to recently released court documents.
Sergeant Jakob Hagerman was accused of being involved in an assault of an unnamed Marine Lance Corporal in Korea.
On May 8th, 2022, Sergeant Hagerman, an unnamed Army Specialist, Private First Class, and a Private were involved in the attack on the Marine near Camp Humphreys, according to court documents obtained by The Salty Soldier.
The altercation occurred outside a bar the Marine fell to the ground after being punched in the face.
As the Marine went to lift his head off the ground, Sergeant Hagerman kicked him in the face and knocked him unconscious.
While unconscious, the unnamed Private First Class stuck the Marine in the head with his foot. A third person then climbed on top of the Marine and punched him in the face numerous times.
Due to the numerous people involved in causing injuries to the Marine, Sergeant Hagerman’s defense argued it would be impossible to determine what brain/neurological damage was specifically caused by Hagerman’s kick.
Hagerman was originally charged with one specification of Aggravated Assault and one specification of Maiming under Article 128 of UCMJ but the Maiming charge was dismissed.
A specification of conspiracy to commit an assault consummated by a battery, in violation of Article 81 of UCMJ was also dismissed.
On 17 January 2024, while assigned to the 2nd Battalion, 37th Armored Regiment, 1st Armored Brigade, 1st Armored Division, he was convicted of one specification of aggravated assault in violation of Article 128, UCMJ during a general court-martial at Fort Bliss.
He was sentenced to be reduced to the grade of E-2 and to be confined for 121 days.
